Being Fired If you simply refuse to be demoted, your employer could fire you. If you lose your job because you refused to be demoted, this would qualify as your own fault. Because of this, the unemployment system would most likely deny your claim for benefits.

How do you deal with unfair demotion?

If you were demoted based on discrimination, it may be best to seek an employment attorney. They can help you sort through which state or federal laws apply. They can also refer you to the right government agency to file a complaint. They can also seek resolution through arbitration or mediation.

Can I refuse demotion?

If you have not yet agreed to the role change then you could refuse to do so. However, if your employer has proposed demotion as an alternative to dismissal, this course of action does pose a serious risk that you will be dismissed.

Can an employer force you to change positions?

Yes, in some cases. Generally, unless an employment contract or a collective bargaining agreement states otherwise, an employer may change an employee’s job duties, schedule or work location without the employee’s consent.

Can you appeal a demotion?

In particular, you may be well within their rights to resign and claim constructive dismissal on the basis of breach of trust and confidence where you have not been given an opportunity to appeal any demotion imposed upon you by way of sanction for misconduct or poor performance.

Can you demote an employee without warning?

When you work as an at-will employee, your employer has the right to demote you. As an at-will employee, you do not have any way to prevent getting fired or demoted. Your employer has the right to give you any position he wants. When an employer demotes an employee, he does not have to provide notice, either.

Can I be demoted without warning?

Not exactly. In order to demote an employee, you should expressly reserve the right to do so in the Contract of Employment. If you are demoting the employee for capability reasons, you need to give them fair warning and provide them with the opportunity to improve their performance issues.
